Terms of Service

These Terms of Service ("Terms") govern your use of the FieldMaster mobile application and related services (collectively, the "Service") provided by Paragon Irrigation LLC ("Paragon Irrigation", "we", "us", or "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organisation you represent. The Service is intended for professional and commercial agricultural use.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@paragonirrigation.com if you suspect unauthorised access.

3. Licence

Subject to these Terms, Paragon Irrigation grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for managing your irrigation systems.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law.
Attempt to reverse-engineer, decompile, or disassemble the App or firmware.
Access the Service using automated scripts, bots, or crawlers.
Interfere with or disrupt the integrity or performance of the Service.
Attempt to gain unauthorised access to our systems or other users' accounts.
Use the Service to control hardware in a manner that may cause property damage or personal injury without appropriate safeguards.

5. Hardware and Physical Safety

The Service enables remote control of physical irrigation hardware. You are solely responsible for ensuring that any remote commands you issue are safe, appropriate, and compliant with local water-use regulations. Paragon Irrigation is not liable for property damage, crop loss, flooding, or other physical consequences arising from the use or misuse of remote control features.

6. Data

You retain ownership of the farm data, configurations, and schedules you create. By using the Service you grant Paragon Irrigation a limited licence to store, process, and transmit this data solely to provide the Service. See our Privacy Policy for details on how we handle your data.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Remote irrigation control depends on internet connectivity at both the App and controller locations. We are not liable for losses arising from connectivity interruptions, cloud-service outages, or hardware failures.

8. Third-Party Services

The Service integrates with third-party providers including ThingsBoard (IoT platform), Cloudflare (infrastructure), Open-Meteo (weather), and Copernicus/Sentinel Hub (satellite imagery). These providers are subject to their own terms and privacy policies. Paragon Irrigation is not responsible for the availability or conduct of third-party services.

9. Intellectual Property

All software, firmware, trademarks, and content in the Service are the property of Paragon Irrigation LLC or its licensors and are protected by intellectual property laws. These Terms do not transfer any intellectual property rights to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARAGON IRRIGATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, CROPS, DATA, OR GOODWILL) ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Account Deletion

You may delete your account at any time via Settings → Delete Account in the App. Deletion permanently removes your account and all associated data from our servers within 7 days. See our Privacy Policy for details.

13. Termination

We may suspend or terminate your account if you violate these Terms or if we discontinue the Service, with reasonable notice where practicable. Upon termination, your licence to use the App ends and we may delete your data in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the United States and the state in which Paragon Irrigation LLC is incorporated, without regard to conflict-of-law principles.
